Terms and conditions

The online store www.aquaregia.lt takes care of consumers’ rights. The consumer may not waive the rights granted to him by the Law on the Protection of Consumer Rights and the Civil Code. Provisions of contracts that are in conflict with the Law on Consumer Protection are considered invalid, in which case the provisions of the Law on Consumer Protection and the Civil Code apply. The purpose of these Terms and Conditions is not to restrict or prevent the exercise of the Consumer rights established by the mandatory legal norms, therefore any doubts must be interpreted in favor of the User. In case of possible and unforeseen non-compliance of the provisions of these Terms and Conditions with the legal acts, the provisions of the legal acts shall prevail and the Seller shall apply them.

1. Basic provisions

1.1. These Purchase and Sale Terms and Conditions (hereinafter – the Terms) establish the mutual rights, obligations and responsibilities of the person purchasing the goods in the e-shop www.aquaregia.lt (hereinafter – the Buyer) and MB Aqua regia (hereinafter – the Seller), company code 305762648.

1.2. By purchasing goods in the e-shop, the Buyer agrees to the application of these Terms.

1.3. When using the Online Store, the Buyer’s terminal and IT system must comply with the Technical Requirements.

1.4. The Purchase and Sale Agreement between the Buyer and the Seller shall be deemed concluded from the moment when the Buyer has formed a shopping cart in the e-shop, provided the delivery address, selected the payment method and read these Terms, presses the “Pay” button and is valid until full performance.

2. Rights and obligations of the Seller

2.1. The Seller has the right to unilaterally change these Terms by publishing them on the e-shop website.

2.2. The amendments become effective for all post-publication transactions from the date of publication.

2.3. The Seller undertakes to make efforts to enable the Buyer to properly use the services provided by the e-shop.

2.4. The Seller does not provide any guarantee that the e-shop will operate continuously or that the data transmission will be error-free.

2.5. The Seller shall not be liable for any losses of the Buyer related to the malfunction of the e-shop and (or) data transmission errors.

2.6. The Seller, if important circumstances arise, unable to provide the Buyer with the ordered goods, undertakes to offer a similar product or return the money paid by the Buyer within 3 working days. In this case, the Seller is released from liability for non-delivery of the goods.

2.7. The Seller has other rights and obligations provided for within the law of the Republic of Lithuania.

3. Buyer’s rights and obligations

3.1. The Buyer has the right to purchase goods in the e-shop in accordance with these Terms and the law of the Republic of Lithuania.

3.2. Upon receipt of the consignment, the Buyer must check that the consignment (packaging) is not damaged. It is also necessary to check that the shipment has not been damaged from the inside or that all the ordered goods have arrived. If the Buyer notices any defects, the Buyer must inform the Seller.

3.3. The Buyer must pay the price for the goods and its delivery, as well as other payments (if such are specified when concluding the contract) and accept the ordered goods.

3.4. The Buyer pays for the goods via on-line banking

3.5. The Buyer must confirm the payment in the Buyer’s bank, via a link provided from the e-shop, or make a payment from any other bank immediately after clicking the “Pay” button.

3.6. If the Seller does not receive information about the payment, the Seller has the right to consider that the Buyer has withdrawn from the sales contract.

3.7. The Seller considers that the Buyer has paid for the goods from the moment when the full amount is credited to the Seller’s bank account.

3.8. If the data provided in the Buyer’s registration form changes, the Buyer must update them immediately.

3.9. The Buyer has other rights and obligations provided for in the Terms and the law of the Republic of Lithuania.

4. Delivery of goods

4.1. Goods in the territory of the Republic of Lithuania are delivered to the post office/terminals by a courier company specified by the Seller.

4.2. The goods will be sent to the Buyer within 1-3 working days from the confirmation of payment.

4.3. In all cases, the Seller is released from liability for non-compliance with the terms of delivery of the goods, if the goods are not delivered to the Buyer or are not delivered on time due to the fault of the Buyer or due to circumstances beyond the Seller’s control.

4.4. The Buyer takes responsibility to accept the delivery. Upon delivery of the goods to the address specified in the order, the goods shall be deemed to have been properly delivered to the Buyer, regardless of whether the goods were actually received by the Buyer or any other person who received the goods at the specified address. In this case, the Buyer has no right to make claims to the Seller, regarding the delivery of the goods to the wrong entity and / or other claims related to the delivery.

5. Return of goods

5.1. In case the product is of poor quality or damaged, the Buyer must inform aquaregia.lt by e-mail about the defects within 48 hours by e-mail: aquaregia.lt or by phone: +370 699 75 977, +370 683 34 089

5.2. The goods are returned in the original packaging and the consignment together with the goods documents. Before returning the goods, the Buyer must contact the Seller by e-mail. email info@aquaregia.lt

5.3. The Buyer is responsible for the proper assembly and packaging of the returned goods. If the goods are not completed and (or) properly packaged, the Seller will not accept the returned goods.

5.4. The Seller will cover the return cost of the defective product and will replace it or issue a refund.

5.5. In the event that the Buyer wishes to receive a refund for returned goods of poor quality, the Buyer must e-mail a request for a refund to info@aquaregia.lt. In the request for a refund, the Buyer must include: name, surname, order number, name and quantity of the defective item, and the reason for the refund. The money is returned to the Buyer to the bank account from which the goods were paid for. The money is returned within 3 working days from the return of the goods to the Seller and the Buyer’s written (e-mail) request.

5.6. In all cases of return, the Buyer must first contact the Seller and only after receiving the confirmation from Customer Care to proceed with the return.

6. General responsibility

6.1. The Buyer is responsible for the accuracy of the data provided in the registration form. The Buyer accepts responsibility for the consequences of incorrect or inaccurate data in the registration form.

6.2. The parties shall be liable for the violation of the purchase and sale agreement concluded using the electronic store in accordance with the procedure established by the law of the Republic of Lithuania.

6.3. The Seller is not responsible for the fact that the goods displayed in the e-shop do not correspond in their color, shape or other parameters to the actual size, shape and color of the goods due to the characteristics of the monitor used by the Buyer.

7. Processing of personal data

7.1. By clicking the “Pay” button, the Buyer confirms that The Buyer agrees to provide the Seller with their personal data and does not object to the Seller’s processing of the Buyer’s personal data for identification, contracting, execution (online trade) and direct marketing purposes (name, surname, e-mail address where consent is given by the Buyer).

7.2. The Buyer confirms that they are informed of their right to access their personal data processed by the Seller and how it is processed, to demand the correction, termination of their personal data or to suspend the processing of their personal data, when the data is processed in violation of the law, not to consent to processing their personal data.

8. Sending information

8.1. The Seller shall send all notices to the e-mail address provided in the Buyer’s registration form.

8.2. The Buyer shall send all notices and questions by the means of communication provided in the Seller’s e-shop (e-mail: info@aquaregia.lt). Operating hours are on weekdays from 9:00. until 20:00

9. Final provisions

9.1. All disputes arising out of or in connection with the contract of sale between the Buyer and the Seller shall be settled by negotiation. In case of failure to reach an agreement, disagreements shall be resolved in accordance with the procedure established in the law of the Republic of Lithuania.

9.2. All textual and graphic information published in the e-shop www.aquaregia.lt is protected in accordance with the laws of the Republic of Lithuania and is the intellectual property of the Seller.
